Over the past 12 months, we have collected the following types of personal information:

Identifiers, such as name, photograph, email address, shipping address, and telephone number. We may disclose this information to service providers, and to others as required by law.
Commercial Information, such as purchase history and product preferences. We may disclose this information to service providers and to others as required by law.
Internet activity information, such as your IP address, device ID, device, or browser type, and browsing behavior. We may disclose this information to service providers, marketing partners, and to others as required by law.
Non-precise geolocation data, which we derive from certain information like your IP address. We may disclose this information to service providers, marketing partners, and to others as required by law.
Sensitive Personal Information, such as your age, gender. Our service providers may also collect your billing information and credit and/or debit card number. We may disclose this information to service providers and to others as required by law.

We use Sensitive Personal Information for legally permitted business purposes, including to (i) perform services or provide goods reasonably expected by an average person; (ii) detect security incidents; (iii) resist malicious, deceptive or illegal actions; (iv) ensure the physical safety of individuals; (v) for short-term, transient use; (vi) perform or provide internal business services; or (vii) verify or maintain the quality or safety of a service or device. We do not sell or share (as defined under California law) any Sensitive Personal Information.

We collect this personal information from the following sources:

Directly from you when you provide it to us, such as when you contact us via form, email, or phone, purchase a product, or otherwise use our Website.
Automatically as you navigate through the Website. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies. From third parties such as social media sites, business partners and when you post reviews or discuss Radio Flyer on social media.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Website, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns. For more information, please visit our Cookie Notice.

Google Analytics. With your consent, we use Google Analytics, a Google service that uses cookies and other similar technologies to collect and analyze information about use of our Website and report on activities and website trends. Our Website does not currently respond to “Do Not Track” browser settings or similar mechanisms. Global Privacy Control (GPC) allows individuals to automatically signal their privacy preferences to websites and other online services through their browser or through an extension. If we receive a GPC signal to opt-out of website tracking, we will honor such requests.

To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceedings, in which personal information held by the Company about our Website users is among the assets transferred.

Data Security

We take reasonable steps designed to secure the personal information we collect. However, the transmission of information via the internet is not completely secure. We cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk.

We do not sell personal information for monetary consideration. However, our use of certain website tracking-technologies may meet the definition of “selling” or “sharing” as that term is defined by applicable law. We may have sold or shared the following categories of personal information with our targeted advertising service providers and partners: Identifiers, Geolocation Data, and Internet Activity Information. We do not knowingly sell the personal information of minors under 18.

Retention of Personal Information

We will store your personal information for no longer than is necessary for the performance of our obligations or to achieve the purposes for which the information was collected, or as may be permitted under applicable law. To determine the appropriate retention period, we will consider the following: the amount, nature and sensitivity of the data; the potential risk of harm from unauthorized use or disclosure of data; the purposes for which we process the data; whether we can achieve the purposes through other means; and the applicable legal requirements.

In the absence of applicable exceptions:

the information collected on the Website will be kept until the complete processing of your request;
your internet or other electronic network activity information will be kept for thirteen (13) months.

Otherwise, your personal information will be kept as long as

We have a relationship with you;
We are required by law;
We need to in order to protect ourselves as a business or protect any other third party;

But in any case, no longer than five (5) to 7 (seven) years for evidence purposes, upon jurisdiction, and unless local laws expressly provide otherwise.

Children Under the Age of 18

Our Website is not intended for children under 18 years of age. If you are under 18, do not use our Website. If we learn we have collected or received personal information from a child under 18, we will delete that information. Third-Party Services

Our Website may contain references and/or links to third-party websites and services. We are not responsible for any third party’s data collection or privacy practices, and we have no control over what information third parties track or collect. Any access to and use of such linked websites is not governed by this Notice but instead is governed by the privacy policies of those third-party websites. We encourage you to review the privacy policies posted on those third-party websites for further information.

Additional California Privacy Disclosures

These Additional California Privacy Disclosures supplement the information contained in the Notice. These Disclosures apply only to individuals residing in California.

We may use and disclose personal information for the business and commercial purposes detailed in the “How We Use Your Information”, “Disclosure of Your Information” and “Selling and Sharing of Personal Information” sections of the Notice.

We retain your information as described in the “Retention of Personal Information” section of the Notice.

Shine the Light

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties to which we disclosed personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

Submitting a Privacy Rights Request

To exercise a right to opt-out of sale, sharing or targeted advertising, please use the “Do Not Sell or Share” link at the bottom of our home page, contact us at customerservice@radioflyer.com or call us at 1-800-621-7613.

To exercise any other rights, please submit a request to us by either calling us at 1-800-621-7613 or by emailing us at customerservice@radioflyer.com. Making a consumer request does not require you to create an account with us. Applicable law may limit the number of times that you can submit a particular request within a 12-month period.

You can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable law.

Upon receiving your request to know, access, delete, or correct, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. We may also use other verification methods as the circumstances dictate. We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. If we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity, and for security or fraud-prevention purposes. We may deny your request to know, access delete or correct if we cannot verify your identity.

Additional EEA and UK Privacy Disclosures

Transfers of your personal information outside the EEA and UK

Your personal information may be transferred to the United States or any other country where Radio Flyer may conduct business, which may have a different data protection regime than the country in which you reside.

If you are based in the EEA or UK, you acknowledge that transferring your personal information is necessary for the review and assessment of your purchase as pre-contractual measures as well as, in case that you order our products/services, for executing the Terms of Services.

Right to delete	You have the right to request the deletion of your personal information (or right to be forgotten), when one of the following conditions applies: you object to the processing of your personal information and there are no overriding legitimate reasons justifying the processing of your personal information (e.g., legal obligation); you object to marketing activities; you decide to withdraw your consent on which the processing is based; your personal information is no longer useful for the original purposes for which it was collected or for any other type of processing; the use that is made of your data does not comply with the applicable legal or regulatory provisions.
Right to restriction of processing	You have the right to request the restriction of the processing during a limited period of time, in particular in order to carry out some verifications, where one of the following conditions applies: you contest the accuracy of your personal information, the processing of which is thus restricted for the period necessary for Radio Flyer to verify the accuracy of such personal information; the processing is unlawful and, rather than requesting their deletion, you prefer to restrict their use; Radio Flyer no longer needs your personal information for the purposes of the processing, but needs for the establishment, exercise or defense of legal claims; you have objected to the processing, which is thus restricted pending the verification of whether the compelling legitimate grounds of Radio Flyer may override your interests, rights and freedoms.
Right to data portability	You have the right to request a copy of your personal information in a structured, commonly used and machine-readable format and also request their transmission to another data controller where technically feasible. This right is not exercised in all circumstances, it applies only if it fulfils all the following conditions: your request is only related to your personal information (excluding anonymous or third-party data); your request does not adversely affect the rights or freedoms of others, in particular those of Radio Flyer (e.g., trade secrets) those of third-parties (e.g.,. intellectual property right); the processing is carried out by automated means (paper files are therefore not included); the processing is based on consent or the performance of a contract.
Right to object	You have the right to object to our processing of your personal information at any time if the processing is based on our legitimate interest. Radio Flyer will no longer process your personal information, unless they demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, such as the respect of a legal obligation or for the establishment, exercise or defense of legal claims.
Right to withdraw your consent	You have the right to withdraw your consent when it has been obtained, without this withdrawal affecting the lawfulness of the personal information processing operations previously carried out.
Other rights	Depending on your country of residence, you may have additional local rights with respect to our processing of your personal information.

Under certain circumstances, we may ask you for specific information in order to confirm your identity and ensure the exercise of your rights. This is another appropriate security measure to ensure that personal information is not disclosed to an individual who does not have the right to receive it.

If we make material changes to this Notice, we will announce and post such changes on the Website for the general public. If you have provided your email address to us, we may also notify you of such material changes via email. If you have an active account with us, we may ask you to affirmatively consent to and accept the changes at the time of your next account log-in on the Website.
